Online Course: Terms & Conditions
This document outlines the terms and conditions for participating in the Shri Atmasiddhi Shastra Online Course (referred to as "the Course"). By enrolling and accessing the Course, the Participant agrees to follow all the rules and guidelines detailed below.
1. Course Overview and Structure
1.1 Course Provider: The Course is conducted by [Enter name of entity e.g., Shrimad Rajchandra Divine Products and Services] under license from Shrimad Rajchandra Adhyatmik Satsang Sadhana Kendra, formally known as Shrimad Rajchandra Mission Dharampur or SRMD.
1.2 Course Title and Format: The Course, titled "Shri Atmasiddhi Shashtra Online Course," is a self-paced online learning program. Participants will be provided with the relevant study material in the form of text and videos as well as bonus content as described later.
1.3 Section Progression and Certification Eligibility: The Participant is expected to study the Course material for each section and successfully complete the examination at the end of each section to move to the next. After successfully completing all sections, as per the assessment criteria outlined here, the Participant will be eligible for certification.
1.4 Duration of Access: Participants have a maximum of twenty-four (24) months from the enrollment date to complete the Course. If the Course is not completed within this time, the Participant will not receive a certificate, regardless of their progress.
1.5 Language: All Course content and related materials are in English.
2. Enrollment, Access, and Course Content
2.1 Once the Participant successfully registers and makes the full payment, they will receive unique login credentials (username and password) to access the course content that is:
- Physical Textbook: Shrimad Rajchandraji's Atmasiddhi Shastra - Six Spiritual Truths of the Soul, a Concise and Complete Commentary by Pujya Gurudevshri Rakeshji.
- Video Lessons: Approximately 111 hours of video content.
- Other Study Materials: Additional study resources like PDF notes and recommended book(s).
2.2 Bonus Sessions: Participants will have access to bonus sessions such as meditations, chanting and live interactive sessions, which may be scheduled at the discretion of the Course provider.
2.3 Login Credentials: The login credentials provided to the Participant are strictly for personal use and cannot be transferred to anyone else. The Participant is responsible for keeping their login information confidential and for all activities that happen under their account. If it is found that the Participant has, whether intentionally or unintentionally, shared their secure login credentials with any third party, access to the Course will be immediately revoked. No prior notice will be given before this action is taken.
2.4 Content Sharing Prohibition: The Participant explicitly agrees not to share any Course content, including but not limited to the Physical Textbook, any form of notes, videos, audios, examination/quiz sheets, and/or any other material in any form, or their access credentials with any third party, whether directly or indirectly. This content is protected by the intellectual property rights described in this document.
3. Examination and Assessment Process
3.1 Course Structure and Assessment Components: The Course is divided into twelve (12) mandatory sections. To move from one section to the next, and as part of the overall assessment, each section ends with an examination. This examination has two main parts to evaluate the Participant's understanding and engagement:
- Objective Quizzes: These are automated, multiple-choice or similar format quizzes.
- Subjective Reflections: These are written assignments that require thoughtful responses.
3.2 Objective Quizzes: These quizzes are automatically graded, and a minimum score of seventy percent (70%) is required to pass and unlock the next section. Participants are allowed to retake objective quizzes if they don't achieve the required passing score on their first attempt.
3.3 Subjective Reflections: These reflections will be manually graded by trained personnel (referred to as "Assessors") chosen by the Course provider. If a subjective reflection does not meet the passing criteria, the Participant will need to resubmit it with the necessary improvements.
3.4 Subjective Reflection Grading Process: Generally, grading for subjective reflections will be completed within two (2) weeks of submission. Participants can move on to the next section while waiting for their subjective reflection grades, provided they have already passed the objective quiz for the preceding section.
3.5 Participant Engagement: The Participant will also be assessed on the basis of their engagement in live sessions and online games that are arranged by the Course Provider from time to time. While games may be played multiple times, the score secured in the first attempt will be considered for the final assessment of that section.
3.6 Section Completion and Assessment Weightage: To successfully complete a section and gain access to the next, a Participant must achieve a minimum combined score of seventy percent 70%. When calculating the final marks for a section, the objective quiz, subjective reflections, and Participant Engagement are weighted as 55%, 40%, and 5% respectively.
4. Certification Requirements
4.1 Certification Eligibility: Certification for successful Course completion will only be awarded if the Participant achieves an aggregate score of seventy percent (70%) or higher, across all assessed components.
4.2 Cancellation: A certificate will not be issued if the Course is not completed within the maximum duration of twenty-four (24) months. Additionally, no certificate will be issued if the overall passing percentage of seventy percent (70%) is not achieved.
5. Intellectual Property Rights
5.1 Ownership of Course Materials: All intellectual property rights, including but not limited to copyrights, trademarks, and proprietary rights, in and to all content and materials provided as part of the Shri Atmasiddhi Shastra Online Course, including but not limited to video lessons, audio content, study materials (PDFs, notes, books), quizzes, assessments, graphics, text, images, designs, conduct of games and other interactive sessions, and any other associated intellectual property (hereinafter collectively referred to as "Course Materials"), are exclusively owned by Shrimad Rajchandra Adhyatmik Satsang Sadhana Kendra, formally known as Shrimad Rajchandra Mission Dharampur or SRMD.
5.2 Prohibition of Reproduction and Distribution: The Participant acknowledges and agrees that the Course Materials are confidential and proprietary. Under no circumstances whatsoever shall the Participant, or any third party acting on the Participant's behalf, be permitted to copy, reproduce, duplicate, distribute, transmit, broadcast, display, publish, translate, adapt, modify, create derivative works from, perform, or otherwise exploit the Course Materials, in whole or in part, by any means or in any form, whether now known or hereafter devised, including without limitation, electronic, mechanical, photocopying, recording, or otherwise, without the express prior written consent of SRMD. This prohibition extends to, but is not limited to, sharing access credentials, downloading content for offline access other than as explicitly provided, creating summaries or extracts for public dissemination, or using the Course Materials for any commercial purpose.
5.3 Extraction and Reverse Engineering: The Participant is strictly prohibited from extracting, reverse engineering, de-compiling, or disassembling any part of the Course Materials, including the underlying software or technical components, or attempting to derive the source code of any software used in conjunction with the Course Materials.
6. Personal and Non-Transferable License
6.1 Limited License: Upon enrollment and payment, SRMD grants the Participant a personal, non-exclusive, non-transferable, revocable, and limited license to access and use the Course Materials solely for their individual, personal, and non-commercial educational purposes.
6.2 Restrictions on Use: This license explicitly prohibits any form of sublicensing, resale, rental, lease, lending, or other transfer of the Course Materials or any rights granted herein. The Participant acknowledges that any attempt to transfer or sublicense this license shall be null and void.
7. Assessor Decisions and Query Process
7.1 Selection of Assessors: SRMD reserves the exclusive right to select and appoint the Assessors responsible for grading subjective reflections. SRMD is under no obligation to disclose the identities or qualifications of these Assessors to the Participant or any third party.
7.2 Finality of Assessment: The assessment decisions made by the appointed Assessors regarding subjective reflections are deemed final and binding. These decisions cannot be challenged by the Participant.
7.3 Query Process for Understanding: Notwithstanding the finality of assessment, a Participant may raise a query regarding their subjective reflection grade, strictly with the sole intention of seeking better understanding of the feedback provided or the subject matter answered. Such queries shall not constitute an appeal against the grade itself.
7.4 Method of Query Submission: All queries regarding subjective reflections, as per Section 7.3, must be submitted through the available channels at https://srmdcourses.org/asji-support/ Queries submitted through any other channel may not be processed.
7.5 Format of Query: Queries must be concise, clearly state the specific point of inquiry, and maintain a respectful tone.
8. User Conduct and Honor Code
8.1 Honest Participation: The Participant commits to honest and ethical participation throughout the Course, including all assessments.
8.2 Prohibition of External Assistance: The use of artificial intelligence (AI) tools, external assistance, or any unauthorized resources for generating or influencing answers for assessments is strictly prohibited.
8.3 Academic Integrity: Cheating, plagiarism, impersonation during assessments, or any other form of academic dishonesty will result in severe penalties.
8.4 Consequences of Violation: Violation of these terms may lead to immediate disqualification from the Course, suspension of the Participant's account, and forfeiture of all Course fees and any right to certification, without prior notice.
9. Data Privacy and Communication
9.1 All personal information provided by the Participant will be stored securely and utilized solely for purposes related to Course communication, progress tracking, and administration.
9.2 Participants may be provided with the option to opt-in for receiving updates or newsletters from SRMD.
9.3 Participant data (including answers) will not be sold, shared, or rented to any third parties for marketing or other unrelated purposes.
10. Support and Disclaimers
10.1 Platform Support: Technical support will be provided for issues pertaining to platform access, login difficulties, and progress tracking within the Course interface.
10.2 Liability Limitations: SRMD shall not be held liable for any technical issues, disruptions, or inconveniences experienced by the Participant arising from their own hardware, software, internet connection, or other personal technological or other applied infrastructure.
10.3 Outcome Dependency: The outcomes and benefits derived from the Course are contingent upon the Participant's individual effort, sincerity, and dedication. SRMD makes no guarantee or warranty of any specific spiritual or academic attainment as a result of Course participation.
11. Refund Policy
11.1 No Refunds Under Any Circumstances: All Course fees are non-refundable under any circumstances, including but not limited to non-completion of the Course, failure to clear examinations, dissatisfaction with Course content, or technical issues on the Participant's end.
12. Technical Requirements
12.1 Participant's Responsibility: The Participant is solely responsible for ensuring they possess the necessary hardware, software, and internet connectivity to access and participate in the Course. This includes, but is not limited to, a stable internet connection of at least 40mbps if connecting via a laptop, desktop or tablet and an uninterrupted network coverage of at least 4G connection if connecting via a Phone or Tablet, a compatible web browser (e.g., latest versions of Chrome, Firefox, Safari, Edge), and audio/video playback capabilities.
12.2 No Liability for Technical Failures: SRMD shall not be held liable for any interruptions, delays, or failures in Course access or performance resulting from the Participant's inadequate technical setup or internet issues.
13. Modifications to Course Content and Terms
13.1 Right to Modify Course Content: SRMD reserves the right to update, modify, or remove any part of the Course content, including video lessons, study materials, quizzes, or bonus content, at its sole discretion, without prior notice to the Participant, provided that such modifications do not fundamentally alter the core objectives or scope of the Course.
13.2 Right to Modify Terms and Conditions: SRMD reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting the revised terms on the Course platform or notifying Participants via email. Continued participation in the Course after such modifications constitutes the Participant's acceptance of the revised Terms and Conditions.
14. Termination of Access
14.1 Termination by Participant: The Participant may cease participation in the Course at any time. However, such cessation does not entitle the Participant to a refund of Course fees, as explicitly stated in Section 11 (Refund Policy).
14.2 Termination by SRMD: In addition to the provisions of Section 2.3 and Section 8.4, SRMD reserves the right to terminate a Participant's access to the Course immediately and without refund for any of the following reasons:
- Breach of any provision of these Terms and Conditions.
- Violation of the intellectual property rights of SRMD or third parties.
- Disruptive, offensive, or any inappropriate conduct towards other participants, Assessors, or SRMD staff.
- Any activity that compromises the security or integrity of the Course platform.
15. Governing Law and Dispute Resolution
15.1 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
15.2 Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved amicably through good faith negotiations between the parties.
15.3 Exclusive Jurisdiction: If an amicable resolution is not reached, the parties hereby irrevocably submit to the exclusive jurisdiction of the courts located in Valsad, Gujarat, India for the resolution of any disputes arising under these Terms and Conditions.
